Can a custodial parent move out of the county (in CA) with her child if her former spouse disagrees?

A friend is trying to move out of Los Angeles county to a town 300 miles away and is having problems because ';dad'; does not want her to take the kid out of the county. It states in the divorce papers that the kid needs to remain in the county and cannot be taken out without parental permission.Can a custodial parent move out of the county (in CA) with her child if her former spouse disagrees?
The agreement must be followed, unless one or the other petitions for a change. That change may be granted due to a compelling reason, like a job (in these tough times!) or family matters.Can a custodial parent move out of the county (in CA) with her child if her former spouse disagrees?
Your friend needs to abide by the parenting plan and not take the child out of the country....just like ';dad'; had to abide by the parenting plan and pay child support.





Hello....';dad'; has just as many rights to this child as ';mom'; does.





Do you honestly think it is in the child's best interest to be ripped away from it's father? Do you know how hard it is to have a relationship with a child when they live hundreds of miles apart?
We tried to make divorce easier in this country about 30 years ago, but no matter what you do, it's still hard. Just because the legal part is easier, the logistics still can be very difficult.





So that's my answer. No matter how hard you try, divorce is still not easy. Not easy for the kids, not easy for the parents. It's not better for anyone; all it can do is make it less bad.





Learn from your friend's experience, do a good job of choosing your mate. And if you can't do that, then have your tubes tied.
Not if it says she can't in the divorce papers. If she does he can have her charged with kidnapping then HE gets custody of the child and SHE goes to prison. If she wants to move so badly then she needs to get a lawyer and go to court to have that portion of the divorce decree amended.
